Terms & Conditions

  • Constructing, reconstructing (including repaving), relocating or altering a walkway or driveway requires a street work permit that is issued from your District Right-of-Way Management The client is required by the City of Toronto to have the permit described above. METRO PAVERS Inc. requires a copy of this permit before commencing work on your driveway. Regulations governing the construction and widening of a driveway access or walkway to properties abutting a public highway are described in Toronto Municipal Code, Chapter 743, Article VII. METRO PAVERS Inc. will be happy to provide a link or copy of the application created by the City of Toronto if requested.
  • The contractor shall take reasonable steps to protect the work area and adjacent property from damage occasioned by construction and completion of the contractors However, due to the nature of our work and the limitations space/access in and/or out of the work area, METRO PAVERS Inc. and or its employees/trades cannot be held liable or responsible for any damage(s) that may occur during the process of this project and or when employees are not present on site.
  • All work will be performed in accordance with Ontario building codes and in a professional like manner.
  • The agreed price applies only to the project described herein (the “Project”) It does not include additional materials or labour that may be required due to unforeseen alterations arising once this project has begun. This includes amongst other things, damage to grounds.
  • Removal of asphalt or concrete refers to no more than one layer of existing material unless otherwise Removal of flammable materials is not included unless specified in writing herein.
  • METRO PAVERS reserves the right to substitute the above materials with that of equal or superior quality and specifications without notice.
  • METRO PAVERS will make every attempt to abide by any schedule agreed to, subject to weather conditions, availability of materials and matters beyond our control.
  • Guarantees do not cover damage caused by owners’ negligence, including (without limitation), gasoline & oil spills, dents from chairs, tire markings or lack of
  • Guarantees do not cover hairline cracks in concrete surfaces as they are an inherent trait of the material itself.
  • METRO PAVERS will not be responsible for unknown sub-grade conditions, lack of drainage due to insufficient grade or damage to unknown pipes or wires, etc. under, near or around the work area(s).
  • METRO PAVERS will not be responsible for acquiring permits or “locates” (if required).
  • It is agreed that METRO PAVERS will not be liable to the client(s), tenant(s) visitor(s), or any other person or persons for damages arising out of disregard for construction barriers or hazards in or around the construction area while the project is in progress and the client agrees to be responsible for notifying all tenants, employees, visitors and other persons on the property of said hazards.
  • METRO PAVERS will not be held responsible for loss of materials left on site once delivered.
  • PAYMENT OF ALL WORK WILL BE DUE IN FULL ON COMPLETION OF THE PROJECT AS DESCRIBED HEREIN UNLESS OTHERWISE AGREED. If payment is not received as per this agreement, all guarantees’ become null and void, courtesy discounts no longer apply and all monies (before discounts) become due as part of the contracted In addition, it is mutually agreed that a 3% per month (42.58% per annum, compounded monthly) charge will be applied to all unpaid balances over 30 days after completion of the above work. An administration fee of $75.00 per (monthly) invoice will be applied to each reminder for outstanding balances owing. These terms and conditions become part of any additional work further agreed to. An administration charge of $300.00 or 25% (whichever is greater) of the pre discounted amount of this order (plus tax) will apply to all orders which are not cancelled, in writing, within two calendar days following acceptance of this agreement.
  • Discounts noted apply as a courtesy only and may be revoked without notice if payment is not received by METRO PAVERS in accordance with this agreement or by the completion date of agreed and/or stated work.
  • Due to current supply chain and transportation issues, prices noted herein may change without prior notice. METRO PAVERS shall advise our clients as soon as we are made aware of any increases, however it is understood that this may occur and all increases will be deemed acceptable unless otherwise noted in writing immediately upon notification to the client. If refused, there may be restocking and or administrative fees charged to return or refuse items, such fees shall be paid by the client.
  • Management rates will be billed at $180.00/hr., administrative and labour rates will be billed at $85.00/hr. outside this
  • If a material cost increase occurs after acceptance of this order and before commencement of the project, the client(s) will be It will be assumed the relative price increase is acceptable by the client(s) unless specified in writing within two days following notice of the increase and before delivery of materials and commencement of work.
  • All materials purchased for related work will remain the property of METRO PAVERS until payment in full is received by METRO PAVERS Inc. It is agreed that such materials may be removed from the job site without notice or permission if payment is not made in full as per this agreement.
  • All unused materials will remain the property of METRO PAVERS and may be removed from the job site unless otherwise agreed in writing by both parties.
  • It is agreed that a METRO PAVERS sign may be erected on the job site for at least two weeks prior to commencement and at least two weeks after completion of the above work.
